Lawson Lundell Litigation Team Wins Major Judgment in Mining Rights Case

On May 16, 2023, our Vancouver Commercial Litigation team won a judgment with a potential value in the hundreds of millions for our client, Orogenic Gold Corp.

The issue at stake was an option agreement on mineral claims in the “Golden Triangle” area of central British Columbia between Orogenic and Richard Mill, its former President, CEO and director. Unbeknownst to Orogenic, Mr. Mill had not transferred title to the mineral claims to it as required under the option agreement, and when Orogenic learned of this, Mr. Mill refused to transfer them. With the option agreement set to expire on June 1, 2023, Orogenic brought the matter on for summary trial. The B.C. Supreme Court ruled that Mr. Mill had breached the agreement, made an order for specific performance for Mr. Mill to transfer title to the mineral claims, and ordered that the option agreement be extended for a further five years.
