Peter Tolensky Quoted in Financial Post Article on B.C. Billionaire Taking Over Hudson’s Bay Leases
Lawson Lundell lawyer Peter Tolensky was quoted in an article by the Financial Post discussing objections from a group of Hudson's Bay landlords to the transfer of more than two dozen leases to British Columbia billionaire Ruby Liu. Hudson's Bay filed for creditor protection in March and recently agreed to sell 28 locations to Liu. Landlords for 23 of those sites oppose the transfer. The outcome may come down to recent changes in the Companies’ Creditors Arrangement Act, which outlines criteria courts must consider when asked to assign leases to a new tenant.
"You can’t go into CCAA as a tenant and then force your landlords to renegotiate their leases as a result," explains Peter.
