Biography

Kelly practices commercial litigation with a focus on energy, securities, and tax litigation. Kelly has argued cases at all levels of court in Alberta, the Tax Court of Canada, and the Alberta Securities Commission. Kelly has experience in resolving disputes through trials and arbitrations, and assists clients in strategically navigating their way through complex problems in a practical and cost-effective way.

Kelly has experience in the following areas:

  • Securities Litigation
    • Active in all areas of corporate securities litigation including shareholder disputes, oppression actions as well as civil claims for breach of fiduciary duty, secondary market misrepresentation and other securities related causes of action
    • Former prosecution counsel with the Alberta Securities Commission, now representing individuals and companies involved in investigations and prosecutions under the Alberta Securities Act including misrepresentation, insider trading and market manipulation matters
  • Energy Litigation
    • Broad range of experience in contractual, joint venture, accounting, royalty, operator and other energy related disputes
    • Environmental liabilities including cost allocation claims and environmental enforcement defence
  • Construction Litigation
    • Experience in industrial, oil & gas, commercial and institutional construction disputes including claims involving product liability, delay and cost overruns, and faulty design and workmanship
    • Representation of owners, contractors, engineering firms and consultants
  • Commercial & General Litigation
    • Extensive experience in contract and tort-based commercial claims
    • Experienced in applications for injunctive relief, attachment orders, Anton Piller orders and orders appointing receivers, receiver-managers and inspectors
