Max Shilleto Publishes Article in The Globe and Mail on Canadians With Disabilities Being Denied the Right to Make a Will
Lawson Lundell lawyer Max Shilleto published an article in The Globe and Mail titled “Too many disabled Canadians are quietly denied the right to make a will.” In the article, he discusses the legal test for whether someone is mentally capable to make a valid will, the bias among legal professionals when working with someone with a mental disability, and how to work in a way that better supports their specific needs.
"The problem lies not in the law, but in how it’s applied. Too often, professionals mistake difference for deficiency. They see a diagnosis, or a non-traditional way of communicating, and assume the person isn’t capable [...]. The role of legal professionals isn’t to screen people. It’s to meet them where they are." - Max Shilleto
