On August 7, 2009, the Supreme Court of Canada released its much
anticipated decision in Nolan v. Kerry (Canada) Inc. The high court
voted 5-2 in favor of upholding a 2007 lower court decision which backed
Kerry’s ability to pay plan administration expenses using plan assets.
