Tom is a commercial litigator, with wide-ranging experience in complex commercial disputes, environmental matters, and real estate and construction litigation. Tom has appeared before all levels of court in British Columbia as lead counsel, and conducted numerous arbitrations and mediations.
Tom has exceptional legal analysis, and is practical, dogged and effective in litigation.
Tom has particular experience in the following areas:
- all aspects of real estate litigation, including closing disputes, complex transactional and financing disputes, certificates of pending litigation, liens and lien relief, crane swing injunctions, commercial landlord and tenant disputes, and residential landlord and tenant matters including ARI-C application hearings;
- injunctions, including emergency injunctions to restrain access to property, Mareva orders and injunctions prohibiting online defamation;
- environmental matters, permitting and licensing challenges, EAO approvals, and contaminated sites claims under the Environmental Management Act;
- aboriginal title and project litigation, including title claims and judicial reviews used to challenge projects;
- construction disputes, including resolving contested lien claims, and delay claims;
- corporate governance, partnership and shareholders disputes, including battles for control, and contested buy-outs; and
- complex contractual disputes.
Tom was recognized for Corporate and Commercial Litigation and Administrative and Public Law in Best Lawyers: Ones to Watch in Canada for 2024. Tom joined Lawson Lundell in 2015. Prior to coming to Canada, Tom practiced commercial litigation in London (UK) from 2011.
