Biography

Jane is an associate in the Vancouver office of Lawson Lundell and a member of the firm’s Litigation and Dispute Resolution Group, where she practices commercial litigation and administrative law. She has experience acting for clients in a wide range of matters, including pension and benefits litigation, property tax appeals, breach of contract claims, shareholder disputes, commercial arbitrations, and regulatory proceedings. Jane has appeared before all levels of court in British Columbia, as well as various tribunals.

Jane clerked for two Justices of the Court of Appeal for British Columbia after joining Lawson Lundell as a summer student in 2018. She returned to the firm to complete her articles in 2020 before joining the firm as an associate.

Jane received her J.D. from the University of Victoria, where she was a member of the winning team in the 2019 BC Law Schools Competitive Moot. Prior to law school, Jane worked as a legal advocate for several years where she clients in disputes before various administrative tribunals, including the Residential Tenancy Branch.

Experience

  • Successfully brought an application for breach of an option agreement, obtaining judgment by way of summary trial on an expedited basis for specific performance. The optionor was ordered to deliver title to certain mineral claims forthwith to the optionee, and the Court extended the option agreement for five years in order to permit the optionee to pursue a going public transaction, which it had been unable to do during the period in which the optionor had refused to deliver title to the claims. The mineral claims are estimated to contain significant recoverable amounts of gold and silver (Orogenic Gold Corp. v. Mill, 2023 BCSC 832).
  • Successfully defended an employer in a claim concerning entitlement to benefits under a supplemental pension plan (Robinson v. Canfor Pulp Ltd., 2023 BCSC 581).
  • Successfully appealed a decision concerning interpretation of a health and welfare benefits trust and obtained an order requiring the trustees to administer the trust so as to give effect to members’ right to transfer benefit providers as set out in the union’s constitution (Union of British Columbia Performers v. Morton, 2023 BCCA 57).
  • Successfully defended a statutory appeal of a decision of the Chief Gold Commissioner in respect of ownership of over 1.75 million tons of waste rock and tailings, estimated to contain significant recoverable amounts of gold and silver (Skeena Resources v. Mill, 2022 BCSC 2032).
  • Successfully appealed a decision of the Property Assessment Appeal Board regarding classification of water treatment facilities at two mines for property tax purposes (Teck Coal Limited v. Assessor of Area # 22 – East Kootenay, 2022 BCSC 2013).
  • Obtained orders directing that liquor licenses be issued following contested public interest hearings (7-Eleven Canada Inc. o/a 7-Eleven 415 Melvin Avenue, Hamilton v. Registrar under the Alcohol and Gaming Commission of Ontario Act, 2019, 2022 CanLII 92730; and 7-Eleven Canada Inc. /a 7-Eleven 622 Upper Wellington Street, Hamilton v. Registrar under the Alcohol and Gaming Commission of Ontario Act, 2019, 2022 CanLII 92747).
  • Obtained an order setting aside default judgment and dismissing a vexatious claim against a homeowner (Grosz v. Royal Trust Corporation of Canada, 2021 BCSC 1313).
  • Obtained an order striking a breach of contract claim against a concrete supplier.
  • Successfully appealed a decision imposing an administrative penalty against an employer before the Workers’ Compensation Appeal Tribunal.
  • Successfully appealed decisions imposing foreign buyers tax and property transfer tax on homebuyers.
  • Assisted various pension plans and health and welfare trusts in recovering funds owing by employers and plan members.
  • Obtained a favourable result for a commercial tenant in a rent arbitration.
  • Negotiated favorable resolutions of shareholder, defamation, and breach of contract claims.
