Rob Sider Quoted in Canadian HR Reporter Article on Use of Non-Union Employees During Strikes

Lawson Lundell lawyer Rob Sider, KC, was quoted in an article by the Canadian HR Reporter about a matter recently before the B.C. Labour Board where it found that an employer used replacement workers illegally during a strike. 

The article discusses when it is appropriate for an employer to use non-union employees to continue operations during a strike and when it is not. “There is a constant struggle between employers who are on strike and unions: the employers are trying to continue to do the work and the unions are trying to prevent the work from being done," Rob said. "Employers typically are going to take an aggressive view of what they’re permitted to do, and unions are going to take a aggressive view as to what they’re not permitted to do.”
