Following a clerkship with the British Columbia Court of Appeal, Marko joined Lawson Lundell in 1999. Marko practices civil and commercial litigation, including securities litigation, pension litigation, class actions, commercial arbitration, and defamation.

Recently, Marko has:

  • successfully defended a major telecommunications company in an action concerning the administration of its pension plan: see Patrick v. TELUS Communications Inc. 2005 BCCA 592 and 2006 BCSC 854;

  • represented the trustees of a long term disability plan in having a claim alleging breach of duty in the administration of the plan summarily dismissed: see Atco Lumber v. Leech, 2006 BCSC 524;

  • successfully resisted having the manufacturer of an allegedly defective product added as a defendant in a products liability action: see West Fraser Mills Ltd. v. Hipp Engineering Ltd.(2005, BCSC);

  • successfully represented the purchaser of a private post secondary school in a commercial arbitration to resolve disputes arising from the purchase;

  • represented a forestry company in recovering royalty payments wrongfully collected from it: see EFP Holdings Limited v. British Columbia, 2002 BCSC 1511, 30 B.L.R. (3d) 140;

  • represented a major BC utility in striking out at a preliminary stage a class action brought against it: see Strata Plan LMS 1816 v. BC Hydro and Power Authority, 2002 BCSC 485, [2002] B.C.J. No. 673;

  • represented both plaintiffs and defendants in defamation actions involving the print media; and

  • represented various financial services companies and their licensed financial advisors in civil actions and in proceedings before the B.C. Securities Commission.

    In recent years, Marko has been an adjunct professor at the University of British Columbia Faculty of Law, lecturing on selected topics in the Advanced Legal Research course, and has been a guest lecturer at the Langara College publishing program on the topic of defamation.
