Lawson Lundell's Transportation Law Group works with companies in the business of providing transportation services and with companies whose business depends on, or incorporates, the transportation of goods and personnel. We have acted for airlines, urban transportation authorities, railways, barge and commercial ferry operators, intermodal service providers, LRT manufacturers and operators, port authorities, terminals and trucking and touring companies.

We have the knowledge and experience to fully and efficiently advise transportation clients with respect to the specific legal framework governing the transportation industry whether it be at the federal, provincial or municipal level, or any combination thereof. In addition, we have considerable knowledge and experience dealing with the unique challenges faced by the transportation industry in relation to its specific commercial, tax, labour and employment, environmental (including the transportation of dangerous goods) and technology issues.

Examples of our work:

  • acting for a major Canadian railway company in the sale and lease of certain shortline railway operations and commercial ferry assets;


  • acting for a major U.S. airline in the licensing of its subsidiary for operations in and out of Canadian
    international airports;


  • defending court challenges to environmental assessment approvals regarding a port development;


  • advising a major urban transportation authority on environmental risks, environmental due diligence, site audits and environmental management systems;


  • advising a large, foreign intermodal carrier on all aspects of carrying on business in Canada, from cross-border immigration of key employees and licensing owner-operators to compliance with Canadian anti-trust law and taxation under applicable tax treaties; and


  • intervening on behalf of a major Canadian railway
    company in a significant regulatory hearing regarding an electrical transmission line proposed to be located in our client's right-of-way.
