Professional Regulation Group

Lawson Lundell’s Professional Regulation Group includes lawyers with extensive counsel experience before a broad range of tribunals and solicitors experienced in the corporate aspects of the governance of regulatory bodies.

Members of our group have expertise in advising and representing regulatory and self-governing bodies (such as the Law Society of British Columbia and the British Columbia College of Teachers) at hearings and before all courts on appeals and judicial reviews.

Our philosophy as counsel is to assist the regulatory body from the early stages of the disciplinary process to achieve a timely and fair result in the public interest, which enhances respect for the regulatory body’s processes and minimizes legal cost.

We also act as counsel for professionals who are subject to regulation, negotiating informal resolution of regulatory disputes wherever possible, and appearing at hearings and in court where necessary to challenge any unfair or unauthorized administrative action.

Some recent examples of our counsel work include:

  • acting for the professional regulatory body; and
Kaburda v. College of Dental Surgeons of B.C.
    (2000), 19 Admin. L.R. (3d) 297 (B.C.S.C.).

Kaburda v. College of Dental Surgeons of B.C.
    2000 BCSC 0481, [2000] B.C.J. No. 555.

  • acting for the regulated professional
Morton v. Joint Building Envelope Qualifications Committee of the Architectural Institute of British Columbia et al (2000), 6 C.L.R. (3d) 124 (B.C.S.C.).

Our lawyers have unique experience in advising on governance issues, in particular, the design and implementation of regulatory processes, in drafting of bylaws and in providing in-service training to administrative decision-makers or to directors/council members on their duties and liabilities.

Consistent with our practice of providing the highest calibre legal services in an efficient and cost-effective manner, our Professional Regulation Group is trained and experienced both in representing clients at mediations and arbitrations and in acting as mediators and arbitrators.
