Lawson Lundell has experience in all aspects of the funding and operation of the medical and health care system in British Columbia. We have acted as counsel in constitutional and administrative law litigation concerning the validity of restrictions imposed upon billing numbers issued to new physicians, the reference-based pricing policy adopted by B.C. Pharmacare and rules of the Board of Examiners in Optometry restricting the freedom of association of optometrists. Our experience also includes acting for both individual practitioners and regulatory bodies in connection with the qualification and regulation of the health care professions, and for pharmaceutical manufacturers in respect of product qualification and product liability issues. Our lawyers include experienced arbitrators and mediators.

We advise individual practitioners and practice groups regarding the regulatory requirements of medical authorities, including regional health districts and hospitals, and the application of medicare practice and billing policies such as patterns of practice and pharmacare rules. Our clients seek our advice on a wide range of issues affecting the health care professions including the negotiation of professional service contracts with public authorities, the establishment of private medical clinics and the treatment of non-resident patients. We also advise our clients on their obligations when serving as expert witnesses and in giving evidence in litigation and regulatory proceedings.

We are able to advise health professionals on all business and commercial issues affecting their practice including incorporation, partnership, group practice arrangements, tax planning, buying and selling of practices, practice financing, acquisition and leasing of premises, staff employment and labour issues and equipment purchase, as well as on matters affecting personal financial and estate planning.
