Lawson Lundell’s Environmental Law Group is regularly involved in corporate transactions, and environmental litigation, including dispute resolution, regulatory defence matters, environmental assessments, toxic torts, permit appeals, administrative actions and regulatory inspections and investigations.

Members of the Environmental Law Group provide advice on an ongoing basis with respect to long-term environmental issues such as:

  • developing environmental management systems;

  • developing voluntary compliance systems;

  • conducting environmental audits and exercising audit information privilege;

  • retaining and utilizing expert environmental consultants; and

  • exercising corporate due diligence.

    We assist a wide variety of clients involved in aluminum smelting, oil and gas, pulp and paper, forest harvesting, mining, transportation (public transit, marine transportation, railway transportation, and port facilities), real estate development and hydroelectric power generation.

    Examples of our work include:

  • acting as counsel in public hearings before federal and provincial boards and commissions involving assessments of projects such as mining projects, oil and gas pipelines, offshore oil shipments, hydroelectric projects, pulp and paper mills, fibreboard plants, sewage disposal systems and aluminum smelting;

  • acting as defence counsel in response to environmental prosecutions under the federal Fisheries Act, the Waste Management Act (British Columbia) and other environmental legislation;

  • representing industrial and commercial clients in administrative appeal processes before boards such as the Environmental Appeal Board, Forest Appeal Board, the Forest Appeals Commission and the National Energy Board;

  • working closely with our clients and environmental consultants in a wide variety of environmental investigations in order to facilitate the remediation and development of contaminated sites;

  • conducting civil litigation including damage claims between private parties and applications for injunctions and other relief brought by aboriginal or environmental groups; and

  • providing legal advice on environmental risks and issues related to all aspects of commercial transactions, including mergers and acquisitions, share or asset transactions, debt financing, real estate development and property management and leasing.

    Our Environmental Law Group is able to advise and assist clients with activities in British Columbia, Alberta, the Northwest Territories, Nunavut and Manitoba and, through our agents, in other provincial territories throughout Canada.
