Class Action Law
 
Lawson Lundell’s Class Actions Group has provided advice to, and conducted litigation on behalf of, both corporate defendants and plaintiffs’ groups. We have been actively involved in class action law since 1994, when British Columbia enacted class actions legislation.

Examples of recent class action litigation in which group members have been counsel include:

  • proceedings against a large Canadian financial institution, involving overcharges on mortgage prepayment penalties. The action was certified as a class proceeding and a national settlement has been approved by the courts in British Columbia and Ontario;

  • a case involving various improper mortgage charges which has been brought against a major B.C. credit union;

  • a B.C. institutional client which is a representative plaintiff in an Ontario class action involving securities issues;

  • a class action in which the firm acts for a large utility that has been sued over what are claimed to be improper tariff charges; and

  • a class action involving a claim for $500 million brought by shareholders alleging oppressive and fraudulent acts by various companies and certain of their officers and directors.

    We frequently provide advice to our corporate and institutional clients concerning ways in which to avoid or minimize exposure to class action litigation. Given that we have also acted for plaintiffs groups in class actions, we believe that we are able to give to our corporate clients very practical advice with respect to the strategy and tactics employed by the plaintiffs' bar, including issues relating to the use of the media.
