Environmental Prosecutions
Lawson Lundell’s Environmental Prosecutions Group has extensive experience in regulatory investigations and prosecutions. Members of the group have advised and represented clients in the forestry, hydroelectric, manufacturing, retailing, mining and oil and gas industries who have been investigated, and prosecuted for regulatory violations across Canada. We have been particularly successful in resolving investigations before they become prosecutions.
Our lawyers have been closely involved in providing legal advice and representation in all aspects of regulatory prosecution including:
- Dealing with investigators in the investigation phase
- Representing clients in the search warrant process
- Representing clients during the interview process
- Representing clients in the courts where prosecutions have been brought
- Representing clients in various administrative contravention proceedings

- Representing a major national railway in various environmental and worker health and safety prosecutions in BC, and Ontario
- Representing two of Canada’s largest forest product companies in various forestry, environmental and worker health and safety prosecutions and administrative contraventions in BC
- Representing a national convenience store chain in various tobacco related prosecutions in BC, Alberta, Saskatchewan and Ontario
- Representing a major interior pulp and paper manufacturer on various orders issued under the Environmental Management Act in BC
- Representing a major coastal pulp and paper manufacturer in several investigations under the Fisheries Act and Environmental Management Act
- Representing a University in a Fisheries Act prosecution in BC
- Representing a Crown Corporation in several investigations into violations of the Integrated Pest Management Act
- Representing a Crown Corporation in a fisheries prosecution
- Representing a Crown Corporation in an investigation for violations of the Heritage Conservation Act
